"The bank wants my house"
It does not. A lender wants the loan repaid. Property is an expensive, slow way to recover money and it involves lawyers, court time and carrying costs. This matters because it explains why lenders are often willing to discuss arrangements — they are not doing you a favour, it is simply cheaper for them.
"Once they file, it is over"
A Statement of Claim is the start of a court action, not the end of your options. Redeeming, refinancing and selling generally remain available well after filing, often right up until the court confirms a sale.
"I will lose everything"
If the property sells for more than what is owed plus costs, the surplus is yours. People lose that surplus by leaving the sale to the court process, or by becoming uncontactable — not because the law takes it.
"I have to move out immediately"
Possession sits at the far end of the process. Most people stay considerably longer than they fear — the more useful question is how long you *should* stay, which is a different calculation.
"Alberta is a walk-away province"
This one circulates constantly and oversimplifies badly. Whether a lender can pursue a shortfall depends on your mortgage type, whether it is insured, your documents and the circumstances. Do not plan around a slogan — get your own paperwork read.
"Talking to my lender will trigger something"
Making contact does not accelerate anything. Silence is what moves files toward legal action.
"A cash buyer is my only option"
A cash sale is one option, and it is genuinely right when time is short. It is not the only one, and anyone presenting it as the only one is telling you something about themselves rather than about your situation.
"Getting advice costs money I do not have"
Legal Aid Alberta, the duty counsel and court assistance programmes, free legal clinics and a Licensed Insolvency Trustee's first consultation are all free. The advice that costs money upfront is usually the advice worth avoiding.
