Banff has a constraint that exists almost nowhere else in Canada, and it directly affects selling a home here: Parks Canada enforces eligible-residency requirements, so not everyone who wants to buy is permitted to live here. Foreclosures in Alberta run through the Court of King's Bench. For Banff, that means the Court of King's Bench judicial centre for your area. Title records sit with Alberta has two Land Titles offices, South (Calgary) and North (Edmonton), split at Township 34 just south of Innisfail.
Alberta has 11 King's Bench judicial districts served by 13 court locations — Calgary, Drumheller, Edmonton, Fort McMurray, Grande Prairie, High Level, Hinton, Lethbridge, Medicine Hat, Peace River, Red Deer, St. Paul and Wetaskiwin. Which one covers your property depends on the judicial district it sits in, and we would rather tell you how to check than guess: the court location finder on albertacourts.ca will confirm it, and any document already served on you names the judicial centre on its front page. One thing worth knowing either way — a local Court of Justice building is not the same thing. Foreclosures are heard only in the Court of King's Bench.
Worth knowing: Land Titles counter service has been closed to walk-ins since September 2025, with everything going by mail, courier or drop-box, and practitioners reporting registration turnarounds of roughly 100 days. That backlog is real and it affects how quickly anything involving title can move — plan around it rather than being surprised by it.
